The creation, distribution, and protection of intellectual property is central to the mission of higher education.  We work closely with in-house counsel and other college and university officials in New England and beyond, from liberal arts colleges to large research universities, on a wide range of copyright, branding, licensing, and Internet issues.  We also represent college and university faculty members in publishing matters, including textbook authors in many disciplines.  We are active members of the National Association of College and University Attorneys (NACUA).

  • Draft and negotiate agreements for joint educational ventures and online learning programs.
  • Draft and negotiate independent contractor agreements, software licenses, and copyright use agreements.
  • Represent doctoral students on private sector collaborations, including negotiation and review of Non-Disclosure Agreements.

Trademark Protection

  • Advise educational institutions and cultural and scientific organizations on the selection and registration of trademarks and service marks.
  • Advise and represent institutions in trademark infringement and policing matters.
  • Advise colleges and universities on trademark licensing agreements.

Educational, Scientific and Cultural Organizations

  • Advise museums, radio stations and performance organizations on licensing and permissions questions, including the use of third-party content in performances, publications, and online materials.

  • Register copyright in musical recordings and other creative works.

  • Assist in the selection, registration and enforcement of institutional trademarks.
